Understanding The Probate Process

For many families, the loss of a loved one can be very hard to accept. After taking time for their grief, they turn to carrying out their loved one's final wishes. It is then that they have their first encounter with the probate process in California, and they become confused by the daunting court procedures that they must follow as things move forward.

At my firm, The Law Office of Araceli Tovar, APC, in Chula Vista, I work with individuals and families who need help probating an estate. Whether you are tasked with the administration of an estate or trust, or simply need guidance about what you need to do to have an estate probated, I will help you determine the right steps to take to ensure your loved one's estate plan is carried out properly.

What You Need To Know About Probate

Even in the best, most conflict-free probate administration, it can still take a substantial amount of time and money for the process to complete. It may take up to a year or longer for an estate to get through probate, and by the time it is concluded, there may not be any assets remaining to pass down.

I can help you gather all of the assets of the estate, as well as the debts that belonged to your loved one. Once all of this has been accomplished, the assets still remaining can be transferred to the intended beneficiaries.

Many of my clients want to know what they can do to avoid probate, and this is something to be discussed when creating your estate plan. I will work together with you to review your estate and make any modifications necessary to help avoid a needlessly long and complicated probate administration.

I work with families to offer you detailed guidance to help you do things right the first time, and thereby prevent even longer delays due to procedural court delays and disputes regarding the estate.
